The online shopping terms and conditions ("On-Line Shopping T &a C's") apply to all and every order that you, the customer, place using the website www.poetrystores.co.za (referred to as "Website"), operated under the Poetry brand ("Poetry") by us, Cape Union Mart Pty. Limited International ("us" , "our" , "we"). Please read them carefully, familiarizing yourself before you make an order. You can even print a copy for future reference.
By clicking on the "Accept" button you accept and agree to be bound by these On-Line Shopping T & C's, the Privacy Statement and such other policies. Nothing in these various agreements is constituted as being illegal.
We reserve the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.
Orders for Delivery Outside South Africa
Please note that we do not currently deliver outside of South Africa. Please note that we reserve the right to accept or reject any request to deliver overseas.
We only sell items to adults (i.e. those aged 18 or over). If you are under 18, you may use this Website only with the involvement of a parent or guardian.
Colours, specifications and dimensions of products
We have made every effort to display, as accurately as possible, the colours, specifications and dimensions of items on the Website. The colours you view on your monitor are impacted by your monitor resolution. We cannot guarantee that what you see is an accurate representation of the item's true colour. Similarly, the sizes we display on our Website might not necessarily be of the exact dimension of other items (Poetry brand or other, external brand) promoted as being of a similar size. Please be aware that we might vary the dimensions and specifications on our Website without prior notice.
Availability of items and substitution
We accept orders for items subject to availability. If for any reason the items you ordered are no longer available, we will contact you (using the contact details you supplied when placing your order) and either offer you an alternative item, or cancel the item from your order and give you a full refund in respect of that item.
If we are unable to contact you or do not receive a response from you, we will process any remaining items on your order and refund you for the items we were unable to supply.
Please note that this section of the (“On-Line Shopping T & C’s”) apply specifically to the Poetry Gift Registry.
What is the Poetry Gift Registry?
The Poetry Gift Registry ("Registry") is an online facility that allows users to create Registries for personal events (weddings, birthdays, bar mitzvahs etc.). The user responsible for creating the gift registry ("User", "you") then invites his or her guests ("Guest" or "Guests") to view the Registry. Guests purchase gifts off the the Registry in a similar fashion to as if they were ordering online, but are given the option of either delivering the gift themselves, or having the gift delivered to the User before his/her celebration.
In order to use the Registry function on the Website, you need to register a profile. You are responsible for maintaining the confidentiality of your account name and password, in order to prevent unauthorized use of your account. In creating a profile, you agree to accept responsibility for all activity that occurs under that profile. Please ensure that your information is kept safe.
If you believe that someone has gained access to your username and/or password, and is using either of these details in an unauthorized manner, please call us.
You can edit your profile details via your account.
Privacy and Communications
We do not disclose any of your personal details to other companies or individuals. We do not keep a record of, or store, any part of your credit card details.
We do keep records of certain personally identifiable information, such as your name, contact details, shipping address and billing address. This information is very often necessary in processing your order.
The contract between us
When you place an order to purchase items using our Website you are indicating that you want to purchase those items from us. We will confirm receipt of your order by sending you an email summarizing the details of your order ("Order Confirmation E-mail"). We will then process your order, and send your ordered items to the address that you provided.
Products are invoiced in ZAR (South African Rands). Prices displayed on the Website include Value Added Tax (VAT). There is a standard delivery charge of R75 per order. This delivery charge may change without notice but, for the time being, is standard irrespective of where in South Africa you want your order to be delivered.
Although we try to ensure that all prices on the Website are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order or cancelling it. If we are unable to contact you, we will cancel your order.
The prices displayed on the website are reflective of those in store. Please be aware that errors do occur.
You may pay for the items which you order online by supplying your credit card details on the secure online order form. We regret that we cannot accept cheques, gift vouchers or cash as payment online.
Poetry does not accept cheques for payment in any of their stores.
Standard deliveries to South African addresses:
Poetry guarantees that all orders will be delivered within 5 - 7 working days of the completed order. Please note that this promised time period (5 - 7 working days) is no longer applicable if there is no one to sign for the parcel at the address for which delivery was intended. All deliveries are made via courier and therefore online orders require a physical address for delivery.
If you wish to cancel your order, please contact our Customer Services Department on +27 (21) 464 5800. We try to process orders immediately, and thus it is not always possible to prevent an order from being despatched. If your order has already been despatched you may return the items to us in accordance with our Returns Policy (below).
Items damaged in transit
If you take delivery of a package from us and the contents have been damaged in transit, we will exchange the damaged items without charge to you provided you return the damaged item(s) to us within 30 days of taking delivery.
Return a faulty item within a reasonable period of time, and we will replace it.
If we have sent you an incorrect item, please notify our Customer Service Department as soon as possible and return the incorrect item to us and specify the correct details in writing. We will not charge you for the incorrect item, and reimburse you the reasonable costs of you delivering it back to us.
We will reimburse any reasonable costs you incur in returning the following items to us:
- items delivered to you erroneously
- items which were damaged upon delivery or are defective or incorrect;
